Jamshid Muhtorov: “I am not a terrorist! I have never supported any terrorist organization”

To whom in my concern: I would like to request a visit from a representative concerning my human rights and my unfair incarceration. The accusations by the federal government are not true. I have not broken any laws. I have never supported any terrorist organizations. In nearly four years neither the Prosecution nor the Public Defender has made any progress with my case. I have been incarcerated without clear proof or given any evidence showing motive of guilt. For two and half years I was placed in solitary confinement without a justifiable reason. Several times the facilities have violated my rights. I am constantly facing discrimination, abuse and humiliation from jail administrators. The jail administrators have intentionally refused my requests for religious meals. It is my right by law to get them. The jail administrators prevent me from participating in Islamic services, as well as any meeting with imam (Muslim pastor), they reject medical services and ignore my grievance requests.

I have not received all of the discovery on my case. I have requested from the Public Defender my entire discovery on many occasions. My Public Defender intentionally withheld important parts of my discovery. I feel my lawyers are not honest with me. Why am I been punished without conviction and without conviction and without clear evidence? I want to know how much longer I have to wait to get a basic answer to this basic question.

My lawyers have prevented me from speaking out or meeting with the media. They have isolated me from contact with others. I don’t trust them. I have requested two times on June 02, 2015 and August 22, 2015 for Judge John Kane to appoint me new counsel. I have not received an answer on this. I am asking from you to help me please replace my attorneys with a highly qualified attorney that works independent from the government, or one that can be trusted to work hard on my behalf. I am a refugee and I can’t afford to pay an attorney.

I would like to find a way to save me, my family and friends from malicious persecution and black mail from the federal government. Muslims who know me or my family are in fear of being labeled terrorists or friends of terrorists causing people to distance them selves from my family and myself. We all have a dream of living in the United States in peace with our families and to practice our religion without discrimination. I cannot become a spy against Muslims or help the government fight against Islam because I am a peaceful family man who wishes to live a long and happy life.

Why the Judge deny my motions to be released on conditions under the Bail Reform Act?

On February 14, 2012, a detention hearing was held before United State Magistrate Judge Hagarty. On February 15, 2012 the magistrate judge relying on false evidence witch was provided by the government issued an order of detention. I obtained this document (order of detention) three years and seven months latter on August 18, 2015. I am a political refugee in this country legally I have lived and have been employed in the United State for five years before my arrest. I have no criminal history. My back ground is excellent. I have no violations or caused any trouble my whole life. I have been incarcerated for four years during that time I have not committed any violations or caused any trouble. Unfortunately the judge is relying on false accusations and has refused to give me a bond or release me.

In the ORDER OF DETENTION document 24, page 3 and (b) document 799, page 11 and 13 filed August 7, 2015. Governments response to defendant Muhtorovs motion for reconsideration of bail based on the extraordinary length of pretrial detention written by District Attorney John F. Walsh, Assistant District Attorney Gregory Holloway and department of justice security divisions counterterrorism section Attorney Erin Creegan.

(1) (a) “Defendant was apprehended attempting to board an airplane on a one way ticket to Turkey”. (b) “Defendant Muhtorov was arrested at the airport as he attempted to travel to Uzbekistan to join the I.J.U. (Islamic Jihad Union) and his facing a lengthy prison.” These accusations are completely false. In fact I can not travel to Uzbekistan my home country because I am a political REFUGEE I was fleeing from there. I wanted to travel to Turkey to study at the Islamic Theological School located in Turkey. I also wanted to visit the United Nations in Turkey to set up immigration processing for my brother Xurshid to bring him from Kazakhstan to the United States. My airline ticket was purchased one way because I did not know the date of my return. Airline tickets purchased in Turkey to the United States are much less expensive. I also planed to reunite with my parents whom I did not seen since January 2, 2006.

(2) (a) “Before this flight he had told his minor daughter that; he may not see her again on earth but, if she is good, would see her in heaven.” This statement is intentionally interpreted wrongly and constructed wrongly. My flight was scheduled to depart on January 21, 2012. According to F.B.I. documents this conversation with my daughter happened immediately before my flight. In fact it took place six month before my flight on July 25, 2011 (see doc SBU_000475). I was working in Chicago Illinois as a long haul truck driver. My home is in Aurora Colorado. I go home to Colorado every 7-10 days. I am away from my family and home a lot. We miss each other very much. My daughter loves me, she always calls and asks me when I am coming back home. Six month before my flight on July 25, 2011. I told her “If you become a good Muslim girl we will be with each other in heaven”. This is a regular religious statement that means in haven we will never be separated from each other. Misinterpreted and miss constructed words and their cultural meanings from country to country and religion to religion they are not always understood or agreed with and must be recognized as such when transferring these words from language to language. The words spoken to my daughter were spoken in the Uzbek language only a religious person from the same culture can recognize the words true meanings. My phrase is taken out of context without full understanding of its meanings. I was employed as a long haul coast to coast truck driver working long hours. Day shift and night shift does not exist in trucking. These phrases where recorded from a man that was over worked and vary tried, a man that had not seen his family for as much as ten days. The government is misinterpreting my phrases and their meanings intentionally.

(3) On the same page the phrase … defendants “teachers” in his faith are Anvar al-Awlaki and Osama bin Laden. This is ABSURD! This is SLANDER against me! I have never been familiar with their teachings. During the investigations and the search of my property the FBI did not find any evidence proving that Anvar al Awlaki (1971-2011) and Osama bin Laden (1957-2011) were my teachers. These accusations are totally false. I can show many examples in my case of false accusations by the FBI obtained from my countrymen through black mail or slander.

An "Order denying motion for reconsideration of bail" ordered by Judge John Kane, document 809 filed August 19, 2015. Judge John Kane relying on false statements from government stating that Muhtorov "has acknowledged membership or affiliation with Islamic Jihad Union." This statement is completely and totally false. According to FBI documnent "Public declaration of the Islamic Jihad Union" (SBU_000007) page 2 states "to conclude, we state that Jamshid Muhtorov has never been a member of the I.J.U. and has never provided any financial support to the group." I.J.U. denied any membership with Muhtorov. How can the FBI claim Muhtorov's membership with I.J.U. when the I.J.U. denies him? Judge John Kane says ... "carrying money and electronic equipment capable of being used by a terrorist organizations;" According to FBI document SBU_000384-000385 this document states electronic equipment of two iPhones and one iPad ordered from me, for to sell to my friend Shamsiddin in Turkey. Not for terrorism. My conversation with him was before my departure January 18, 2012 thru Skype. His Skype name is "al-fajrul."

My family, my parents and I have been paying a high price for this extremely slow and unfair process. My children are without their father, my wife is without her husband, and my family is suffering vary much. My financial support not only takes care of my wife and children, it also supports my parents and my relatives in Uzbekistan. My family is experiencing extreme financial and emotional hardship.

I am a human rights defender. My life is not meaningless. I would like to cry out. “STOP” these injustices! “STOP” oppressing me because of my nationality and religions beliefs! “STOP” this slander and false accusations! I ask you to please help me speak out. Do not let them waste any more of my life being falsely imprisoned.

I request a meeting in person as soon as possible.
